Non si è fatta attendere la risposta della manager nonché ex cantante degli Arch Enemy, Angela Gossow, che ha risposto piccata a quanto sollevato dal fotografo e redattore della webzine Metal Blast J. Salmeron.
“Un po’ di maldicenze oggi su di noi. Bella storia con fatti differenti, copia e incolla di pezzi.
“Per quanto mi riguarda, una breve storia. Un tizio si presenta come un fotografo / avvocato e ci minaccia per una re-post su Instagram: mi assicuro che l’immagine venga rimossa ovunque e che non arrivi mai piùvicino al mio artista.
“Un po’ triste: troppe persone prendono questa storia senza metterla in discussione. Reagiscono con puro odio malvagio … In questi tempi non dovremmo essere allarmati e discostarci da queste “storie”??? Pecore.”

“As for me: short story. Some guy introduces himself as a photographer / lawyer and threatens us over an Instagram re-post. I make sure the picture gets removed everywhere and he doesnt get to come close to my artist ever again.
“Sad bit: Too many people buy into that story without questioning it at all. They react with pure malicious hatred. In this day and age shouldn’t we be alarmed and vary of such ‘stories’??? Sheep.”

A picture got re-posted and tagged (not on my or Arch Enemy’s page). Then I got forwarded an email by Juan introducing himself as a lawyer and photographer and claiming money for said image ”“We had it removed immediately.
Copyright issues, photographers on site we have no rights or choice to decide over what they do with the imagery does make artists feel vulnerable. The result: artists are trying to gain control over the situation again by having photographers sign a bunch of paperwork. We havent done anything like that so far.
There was some miscommunication and misunderstanding along the way, I am sorry if I offended anybody. I got angry. If he would have just introduced himself as a photographer I would have reacted differently as opposed to be receiving a lawyers correspondence, which feels threatening to me. To clarify: there was no extortion or threat in a legal sense.

Loudwire dopo aver contattato Angela Gossow per un commento,ha informato che una risposta ufficiale degli Arch Enemy sarà pubblicata in un secondo momento e che hanno un avvocato che sta esaminando la situazione.
E’ riemersa anche la storia di una fotografa olandese, Anouk Timmermann, bandita anche lei per aver reclamato i diritti su alcune foto:
La fotografa formula richiesta di rimuovere le foto da lei scattate e caricate sul sito personale di Angela Gossow, oppure richiede l’autorizzazione alla pubblicazione pagando 75 euro a foto (per 8 foto in totale). Una responsabile si scusa poi per aver l’errore commesso, ammettendo di aver cancellato le foto.
Infine, nel mese di febbraio 2010 è la stessa Angela Gossow a rispondere alla fotografa, precisando che si assicurerà che la Timmermann non ottenga piùalcun photopass o guestlist per i futuri show degli Arch Enemy:
Il sito Metal Blast nel frattempo è temporaneamente non raggiungibile, probabilmente per il troppo traffico, o, come suggerisce lo stesso redattore, per un attacco ddos (Distributed Denial of Service), che consiste nel tempestare di richieste un sito fino a metterlo ko e renderlo irraggiungibile.
L’articolo ha suscitato molta attenzione e sembra che la direzione della band stia cercando di eliminare le critiche rimuovendo i commenti negativi sulla pagina Facebook degli Arch Enemy e disattivando i commenti su Instagram.

La notizia del ban a vita del fotografo da parte della manager nonché ex cantante degli Arch Enemy sta facendo il giro “dell’Internet” dal giorno di Natale, e la shitstorm globale si è abbattuta sulla band e sulle rispettive pagine social.
La vicenda, per chi ancora non la conoscesse è in breve questa: un fotografo, J. Salmeron, avvocato e anche capo redattore della piccola webzine Metal Blast scatta al festival olandese Frontarock e poi posta una foto della frontwomam Alissa White-Gluz, che la riposta con i crediti del fotografo nel suo profilo instagram. Questa viene a sua volta stata ripostata dalla pagina Instagram di Thunderball Clothing, con riferimenti all’abito indossato per il concerto.
Salmeron, richiede quindi a questi ultimi, dato l’utilizzo a fini commerciali della propria foto, il pagamento o della somma che lui richiede (500€), oppure di concludere bonariamente il malinteso donando 100€ all’associazione olandese contro il cancro.

Your use of my photo is unauthorized and, as I’m sure you are aware, represents a clear and blatant breach of my copyright. This infringement is, of course, made more serious when we take into consideration that your use of my photo is in connection with your business, which you are trying to promote with this post.
In general, I charge a fee of at least €500 (five hundred Euro) to businesses that have posted my work in an unauthorized manner. In this case, however, I would be willing to forget about this problem and let you keep up the above post in exchange for a donation of €100 (one hundred Euro) to the Dutch Cancer Foundation. This is an organization that seeks to benefit cancer research as well as improve the quality of life of cancer patients. La Thunderball Clothing contatta il management degli Arch Enemy, e il fotografo sarà poi contattato da Angela Gossow, informandolo che sarebbe stato bandito da tutti i concerti della band e che avrebbe girato questa mail agli altri promoter:

By the way, we are sure you don’t mind that you are not welcome anymore to take pictures of Arch Enemy performances in the future, at festivals or solo performances. I have copied in the label reps and booking agent who will inform promoters ”“ no band wants to have photographers on site who later send such threatening correspondence to monetise on their images.
Btw, the email below was not from Marta, but from Alissa herself personally. The artist you blatantly wanted to sell the picture to. Nice price tag. 500 EUR. In bcc the band so they know about you in the future.

Le scuse della titolare di Thunderball, Marta Gabriel, nonché cantante dei Crystal Viper, sono arrivate a breve, scusandosi col fotografo e cancellando tutte le foto sul profilo Instagram dei vari repost degli artisti con indosso le sue creazioni.
