Nel lungo post di Angela Gossow del 30 dicembre, il fotografo di Metal Blast, J. Salmeron, ha risposto nei commenti ai punti sollevati dalla manager degli Arch Enemy alla ormai arci-nota saga sull’uso commerciale di una sua foto ritraente Alissa White-Gluz:
“Cara Angela,
“Ti ringrazio molto per l’interesse dimostrato nel rispondere a questo messaggio con un altro commento che dimostra semplicemente l’assoluta incapacità di rispondere alle cose professionalmente:
“1. Tempi di pubblicazione: come ho spiegato piùvolte, a causa di motivi di salute personale, la storia è stata rimandata, non occorrono 6 mesi per scrivere nulla.
“2. Copyright: nella tua prima e-mail, hai detto che “gli sponsor di Alissa e i fan club sono autorizzati a condividere le sue foto”. Questa è stata una falsa dichiarazione in merito al copyright sulla foto, e te l’ho così spiegato. Hai risposto dicendo che siamo stati banditi dai concerti futuri per l’invio di tale “corrispondenza minacciosa” aggiungendo un certo numero di persone (ad esempio, da Century Media) in calce. Sapevi, o almeno dovevi sapere, che dire che ti stavo mandando “minacce” avrebbe messo a repentaglio molto di piùche fare foto ai soli tuoi concerti, ma a TUTTI i concerti, dato che nessuno accredita qualcuno che “minaccia” gli artisti.
“Per quanto riguarda il copyright, sin dalla nostra pubblicazione, abbiamo ricevuto e-mail da altri fotografi, verificandone l’autenticità , in cui hai intrapreso azioni simili contro di loro, chiedendo loro di darti il ”‹”‹loro copyright per “visibilità “e di metterli al bando dagli show di Arch Enemy se si fossero rifiutati. Posso fornire la corrispondenza che avevi con questi fotografi, se vuoi, per rinfrescarti la memoria.
“3. Donazione e licenze [autorizzazioni alla pubblicazione]: hai assolutamente torto sulla questione della donazione: un fotografo può concedere in licenza una foto per qualsiasi cosa desideri, sia esso un granello di sabbia, o una donazione a un ente di beneficenza o un milione di dollari. La tua affermazione sui 500€ è così errata che sono assolutamente sorpreso che tu stia facendo questa dichiarazione.
“4. Libertà di parola: si ha assolutamente libertà di parola, ma con certi limiti.La chiave tra questi limiti è di affermare falsamente che qualcun altro ha commesso un crimine. Tu, Alissa e Jeremy Saffer, apertamente, mi avete accusato di aver commesso una estorsione. Nessuno mette a tacere la tua facoltà di esprimere la tua opinione, ti sto solo ricordando che tu (sì, anche tu) non puoi semplicemente chiamare altri “criminali” senza subire conseguenze. Inoltre, vero, hai cambiato i tuoi messaggi precedenti perché io ho dovuto ricordarti che non si poteva semplicemente accusare falsamente delle persone di crimini. Per essere chiari su questo punto, però, mi hai accusato falsamente del crimine di estorsione e minacce, e questo è il motivo per cui hai rimosso quei commenti, o ti opponi alla tua precedente accusa di chiamarmi estorsore?
5. Corrispondenza “privata”: è molto difficile capire come consideri che la nostra corrispondenza via e-mail, che hai inoltrato a innumerevoli persone, rimanga “privata”. In ogni caso, e anche se vi do del materiale per fare riferimento all’etica degli avvocati europei, NON SONO IL TUO AVVOCATO, né ho agito in qualità di avvocato in quel momento, quindi non sono sicuro di quale riservatezza ci si aspettasse di avere.
6. Thunderball Clothing: perché Marta ha dato il terribile consiglio di sentirsi dire che gestiresti questa situazione, anche se hai chiaramente dimostrato di non capire come funziona il copyright? Lasciami ricordare che il tuo primo messaggio è stato molto chiaro a riguardo, sostenendo che tu ed i tuoi sponsor avevate il diritto di usare le foto, qualcosa che è palesemente falso. Credi di aver fatto un favore a Marta? Come dalle e-mail che sono emerse da te con altri fotografi, sembra essere un modello di comportamento riguardo al modo in cui agisci con i fotografi che contestano l’uso illecito del loro lavoro, quindi presumo che tu sapessi esattamente cosa avresti fatto una volta che a Marta è stato detto che l’avresti “gestita”. Sapevi che questo poteva ritorcersi contro, dal momento che stavi facendo dichiarazioni legalmente false (a qualcuno che SAPEVI essere un avvocato) sperando di tenerlo tranquillo e decidendo di procedere comunque in quel modo. “Il risultato? Marta è senza lavoro. Congratulazioni!
“7. Minacce: ho ricevuto molte minacce contro la mia persona, la mia famiglia e i miei amici, spero che anche voi non tolleriate e perseguitiate attivamente coloro che le pubblicano.
“Spero che nel 2019 tu e la tua famiglia stiate bene. Spero sinceramente, però, che le vostre capacità manageriali miglioreranno nel tempo.
“Come ho già detto in altri posti, continuo a pensare che tu fossi una ottima cantante negli Arch Enemy.

“Thank you very much for your interest in replying to this message with yet another comment which simply demonstrates an absolute inability to answer things professionally:
“1. Time of Publication: As I have explained repeatedly, due to personal health reasons, the story was pushed back. It doesn’t take us 6 months to write anything.
“2. Copyright: In your first e-mail to me, you said ‘Alissa’s sponsors and fan clubs are authorized to share photos of her.’ This was a false statement in regards to the copyright over the photo, and I explained to you as much. You replied saying that we were banned from future concerts for sending such ‘threatening correspondence,’ and added a number of people (for example, from Century Media) in CC. You knew, or at least had to know, that saying that I was sending you ‘threats’ would jeopardize much more than covering just your own concerts, but ANY concerts, since nobody would accredit someone who ‘threatens’ artists.
“As for copyright, since our publication, we have received e-mails from other photographers, the authenticity of which we have verified, where you have taken similar actions against them, demanding they give you their copyright for ‘exposure,’ and banning them from Arch Enemy’s shows once they refused. I can provide the correspondence that you had with these photographers if you want, to refresh your memory.
“3. Donation and Licenses: You are absolutely wrong on the issue of the donation. A photographer can license a photo for literally anything he wants, be it a grain of sand, a donation to a charity, or a million dollars. Your claim about the €500 is so incredibly wrong that I’m absolutely surprised you are making that statement.
“4. Free Speech: You absolutely have freedom of speech, but it recognises certain limits. Key among those limits is to falsely claim that someone else has committed a crime. You, Alissa and Jeremy Saffer, quite openly, accused me of committing the crime of extortion. Nobody is silencing your ability to express your opinion, I am just reminding you that you (yes, even you) are unable to simply call other people criminals without facing consequences. Additionally, true, you changed your previous messages because I had to remind you that you couldn’t simply falsely accuse people of crimes. Just to be clear on this point, however, did you falsely accuse me of the crime of extortion and threats, and that is the reason why you removed those comments, or do you stand by your previous accusation of calling me an extortionist?
“5. ‘Private’ Correspondence: It is very difficult to understand how you consider that our e-mail correspondence, which you forwarded to countless people, remains ‘private.’ In any case, and although I give you props for referencing European lawyers’ ethics, I AM NOT YOUR LAWYER, nor was I acting in a professional capacity as a attorney at the time, so I am not sure which confidentiality you expected to have there.
“6. Thunderball Clothing: Why was Marta given the terrible advice of being told that you would handle this situation, even though you clearly demonstrated not to understand how copyright works? Let me remind you that your first message was very clear on this regard, arguing that you and your sponsors HAD the right to use the photos, something that is patently untrue. Do you think that you did Marta a favor by doing that? As the emails that have surfaced from you with other photographers show, it seems to be a pattern of behavior regarding how you act with photographers who object to infringing use of their work, so I would assume that you knew exactly what you would do once Marta was told that you would ‘handle’ it. You knew that your actions could potentially backfire, since you were making legally false statements (to someone you KNEW was an attorney) hoping to just keep them quiet, and decided to proceed in that fashion anyway. The result? Marta is out of a job. Congratulations!
“7. Threats: I have received plenty of threats against my person, my family and my friends, I hope that you also will not tolerate, and will actively pursue, those who issue them.
“I hope that 2019 will find you and your family doing well. I sincerely hope, however, that your management skills will improve with time.
“As I mentioned in other places, I still think you were a very good singer fronting Arch Enemy.

Il comunicato datato 30 dicembre della Gossow:
Caro chiunque sia interessato all’argomento,
Sto rispondendo al raduno di bulli che questo fotografo ha mandato in giro con le sue ben realizzate [argomentazioni] (ci sono voluti 6 mesi per farlo e pubblicarle), un crogiolo ben organizzato di vari argomenti trattati.
I dettagli spesso si perdono nell’emozione della narrazione – e la narrazione è spesso controllata da chi presenta la storia per prima. Il fotografo ha gettato un mucchio di cose diverse in un modo e lo ha molto enfatizzato. Procediamo a distinguere:
1)
Problema di copyright. Gli Arch Enemy non ha pubblicato nessuna delle sue immagini, nessuna violazione del copyright.
Alissa ha solo reindirizzato la sua immagine e ottenuto il permesso scritto di detto fotografo e in realtà gli è stato chiesto di ri-postare, dopo aver con timore rimosso la foto. Si è astenuta dal farlo.
Conclusione: nessun coinvolgimento della band o di Alissa in nessuna delle questioni affrontate. Lascia fuori Arch Enemy e Alissa.2)
Thunderball Clothing/ Marta: La signora ha ripubblicato la foto e ha detto “grazie per aver indossato il mio vestito personalizzato” insieme a esso. Violazione del copyright, in quanto può essere interpretata come uso commerciale. Non intenzionalmente, perché non era a conoscenza di quella linea sottile – un sacco di persone su internet non lo sanno effettivamente. Qualunque cosa tu ri-posti è una violazione del copyright allora. L’ha rimosso anche immediatamente. Non ha reagito alla richiesta di donazione perché non era sicura che fosse una truffa. Donando a un fondo per la ricerca sul cancro non le permetteva di avere i diritti di usare la foto commercialmente. Solo una fattura a pagamento di detto fotografo potrebbe. Quindi, perché non ha semplicemente fatturato i 500 euro e poi donati a un ente benefico? Sarebbe stato molto piùtrasparente sotto ogni aspetto.
La campagna di odio di internet ha distrutto l’attività di Marta – tutti i clienti esistenti hanno annullato gli ordini e / o restituito gli ordini. Ha ricevuto numerose minacce di morte, accuse di essere un nazista o peggio. Ha chiuso il suo negozio che ha tirato su in 8 anni. L’errore è davvero così grave da giustificare questo? NO. È giustificato distruggere un artista su questo? NO.

Questa è una situazione sfortunata e una conversazione d’affari privata che non è mai stata pensata per l’esposizione pubblica (non etico e contrario al codice di condotta per gli avvocati europei) è stata oggetto di abusi per questa campagna. Stavo facendo la mia posizione nei miei sforzi per rappresentare e proteggere in modo aggressivo il mio cliente e la sua socia in affari. Mi dispiace che questo sia stato reso pubblico e che i problemi siano stati fraintesi. Sono personalmente scioccata dal fatto che una controversia commerciale si sia trasformata in un’ondata di odio così distruttiva.
L’affermazione che l’ho inserito nella lista nera con tutti gli agenti, i festival ecc. è falsa! Ho informato la mia cerchia di persone che non lo voglio piùnel photo-pit degli Arch Enemy. Non ho chiesto a nessun promotore, festival, riviste o chiunque di bandire Mr. fotografo, dammi una persona che ti ha rimosso dal loro libro paga a causa mia. Nessuno? Grazie.
Perché ho cambiato alcune parole nei miei post precedenti – ho ricevuto una lettera legale da parte di detto fotografo che mi ha chiesto di farlo, altrimenti mi avrebbe perseguito legalmente per le mie parole. Lo stesso è accaduto ad Alissa e Jeremy Saffer [noto fotografo che collabora con Alissa White-Gluz, tra gli altri, ndr], che ha tolto tutto il suo post. Quindi quelli vanno oltre per difendersi vengono messi a tacere. Libertà di parola? No, non la penso così. Sono sicuro che dovrò modificare anche un po’ di questo post perché mi aspetto di ricevere di nuovo una lettera legale da lui entro le prossime 24 ore. Solo per dire.
Oh, e ho cancellato la parola “pecora” perché quelle persone che hanno danneggiato Marta in modo irreparabile, che stanno minacciando Alissa e me in modi molto seri non sono pecore – sono molto peggio. Sono bulli.
Desideriamo andare oltre e augurare a Mr Photographer il meglio della carriera.

I am reacting to the bully rally this photographer has set lose with his well crafted (he took 6 months to get it done and released), well timed mash up of different subjects at hand.
The details often get lost in the emotion of the narrative – and the narrative is often controlled by who presents the story first. Mr photographer threw a bunch of different things into one pot and highly emotionalized it. Lets differentiate:
1)
Copyright issue. Arch Enemy did not post any of his pictures, no breach of copyright there.
Alissa only re-tagged his image and got written permission of said photographer and actually got asked to re-post, after she fearfully removed the said photo. She refrained from doing so.
Conclusion: Zero involvement oft he band or Alissa in any of the addressed matters. Leave Arch Enemy and Alissa out of it.2)
Thunderball clothing / Marta: The lady re-posted the picture and said ‘thank you for wearing my custom made outfit’ along with it. Copyright breach, as this can be interpreted as commercial use. Not intentionally, because she wasn’t aware of that fine line – a lot of people on the internet are not actually. Anything you re-post is a breach of copyright actually. She removed as well immediately. She did not react to the donation request because she was not sure if its scam. Donating to a cancer research fund is not going to buy her the rights to use the photo commercially. Only a paid invoice to said photographer would do. So why didn’t he just invoice the 500 EUR and went ahead and donated it to said charity? That would have been much more transparent in every aspect.
The internet hate campaign has destroyed Marta’s business ”“ all existing customers have cancelled their orders and/or returned their orders. She has received numerous death threads, accusations of being a Nazi and worse. She has closed her shop she built up for 8 years over this. Is mistake really that severe to justify this? NO. Is it justified to destroy an artist over this? NO.

This is an unfortunate situation and a private business conversation that was never meant for public consumption (unethical and contrary to the code of conduct for European lawyers) was being abused for this campaign. I was doing my position in my efforts to aggressively represent and protect my client and her business partner. I’m sorry that this has been made public and the issues are now misconstrued. I am personally shocked by the fact a business dispute turned into such a destructive wave of hate.
The claim I had him blacklisted with all agents, festivals etc is false! I did inform my circle of people I do not want him in the Arch Enemy photo pit again. I did not ask any promoters, festivals, magazines or whoever to ban him. Mr. photographer, give me one person who has removed you from their payroll because of me. Nobody? Thank you.
Why I changed some words in my previous posts ”“ I received a legal letter from said Mr. photographer asking me to, otherwise he would pursue me legally for my wordings. The same happened to Alissa and Jeremy Saffer, who took his entire post down. So those going out on the fence defending us are being silenced. Freedom of speech? No, I don’t think so. I am sure I will have to edit some of this post as well because I expect to receive a legal letter from him again within the next 24 hours. Just saying.
Oh, and I took away the word sheep because those people who damaged Marta beyond repair, who are threatening Alissa and me in very serious ways are not sheep ”“ they are much worse. They are bullies.
We wish to move on from this and wish Mr Photographer the best with the career.

Ieri 30 dicembre veniva data con un comunicato ufficiale direttamente dalle mani della titolare la notizia della chiusura di Thunderball Clothing.
Marta Gabriel, nonché cantante dei Crystal Viper, era infatti esasperata dai messaggi di odio e scherno ricevuti dopo che la vicenda ha fatto il giro del mondo. La titolare si era scusata precedentemente scusandosi in un post e cancellando poi tutte le foto legate agli artisti nelle proprie pagine social.

Arriva ora la risposta ufficiale della della manager nonché ex cantante degli Arch Enemy, Angela Gossow, che aveva risposto piccata a quanto sollevato dal fotografo e redattore della webzine Metal Blast J. Salmeron in due precedenti post, di cui uno cancellato:
“Un po’ di maldicenze oggi su di noi. Bella storia con fatti differenti, copia e incolla di pezzi.
“Per quanto mi riguarda, una breve storia. Un tizio si presenta come un fotografo / avvocato e ci minaccia per una re-post su Instagram: mi assicuro che l’immagine venga rimossa ovunque e che non arrivi mai piùvicino al mio artista.
“Un po’ triste: troppe persone prendono questa storia senza metterla in discussione. Reagiscono con puro odio malvagio … In questi tempi non dovremmo essere allarmati e discostarci da queste “storie”??? Pecore.”
Le scuse della titolare di Thunderball, Marta Gabriel, nonché cantante dei Crystal Viper, erano arrivate a breve, scusandosi col fotografo e cancellando tutte le foto sul profilo Instagram dei vari repost degli artisti con indosso le sue creazioni.
